Login requirement for TEAS and TEASi coming on October 26

As part of our efforts to build a more secure trademark filing system, we are implementing changes to the Trademark Electronic Application System (TEAS) and TEASi (international).
Changes effective on October 26:
  • Access to forms: When you enter any TEAS or TEASi form, you will be prompted to log in to your USPTO.gov account with a two-step authentication. We will send you an authentication code during the login process, and you will be required to enter the code to access the form.

  • TEAS time out: Your TEAS or TEASi session will time out after 30 minutes of inactivity. If you are starting a new application, review the minimum filing requirements in the TMEP and the additional TEAS Plus or TEAS RF filing requirements.

USPTO proposes making electronic filing mandatory for trademark submissions

The USPTO published a proposal to change federal trademark law to mandate electronic filing. See the Notice of Proposed Rulemaking (link is external).

Overview of the proposed changes

The proposed changes would generally require trademark applicants and registrants to:
  1. File trademark applications and documents concerning trademark applications and registrations online using the USPTO’s Trademark Electronic Application System (TEAS).
  2. Provide and maintain an accurate email address for receiving correspondence from the USPTO about a particular application or registration.
Our goal is to have end-to-end electronic processing of applications and registrations, resulting in faster processing times and fewer errors. Paper and fax submissions would no longer be accepted. Email submissions would continue to not be accepted.

Submit comments on the proposed changes

We are accepting comments from the public until July 30, 2018. See the Notice of Proposed Rulemaking (link is external) for instructions on how to submit comments.
Read the public comments on our website or on the Federal eRulemaking Portal (link is external).

Trademark: Waiver of Certain Trademark Fee Rules for December 22-27, 2015

All USPTO online systems, including the Trademark Electronic Application System (TEAS), have been restored as of December 28, 2015 following the major power outage at USPTO headquarters that occurred December 22, 2015.

Pursuant to 37 C.F.R. § 2.148, the Director waives the requirements under 37 C.F.R. §2.22 (b)(1)(i)-(viii) and 2.23(b)(1)(i)-(viii) in applications based on TEAS Plus or TEAS RF to submit the identified communications “through TEAS” for the period of December 22, 2015 through December 27, 2015. Communications submitted via alternative filing methods during that period will not incur the additional processing fee under §§ 2.22(c) or 2.23(c) of $50.00 per class, as set forth in § 2.6(a)(1)(v).

The Director also waives the requirement under 37 C.F.R. § 2.6(a)(5)(i) regarding applications for renewal submitted via alternative filing methods (“on paper”) between December 22, 2015 and December 27, 2015. Further, the Director waives the requirement of 37 C.F.R. §2.6(a)(5)(ii) relating to filings for renewal as to the requirement for such filings to be “through TEAS.” Thus, the applicable fee for all applications for renewal of a registration filed between December 22, 2015 and December 27, 2015 is $300.
