TODAY! Final sessions of Intro to IP Webinar Series in Spanish and English

The United States Patent and Trademark Office (USPTO) is offering a new Spanish-language intellectual property (IP) webinar series designed for the entrepreneur, startup, and small business communities.  This free virtual five-part series started on October 6 and repeats every quarter.  USPTO experts lead this series that includes the basics of patents and trademarks plus USPTO resources available to the public.

Deadline for submission of comments on patent eligibility jurisprudence extended to October 15

The United States Patent and Trademark Office (USPTO) has extended the deadline for submitting comments on the state of patent eligibility jurisprudence, and its effect on investment and innovation in the United States, to October 15, 2021.

The comments will assist the USPTO in preparing a report to Congress on how current jurisprudence may impact U.S. investment and innovation, particularly in critical technologies like quantum computing, artificial intelligence, precision medicine, diagnostic methods, and pharmaceutical treatments.

Federal Register Notice requesting the comments was published on July 9, 2021.

Copyright Office Proposes Rules for Initiating Copyright Claims Board Proceedings

The U.S. Copyright Office has issued a proposed rule to establish procedures governing the initial stages of proceedings before the Copyright Claims Board (CCB). The proposed rule also establishes requirements regarding the directory for designated service agents. Initial public comments are due on October 29, 2021. Reply comments are due on November 15, 2021.

The Copyright Alternative in Small-Claims Enforcement (CASE) Act of 2020 directs the Register of Copyrights to establish regulations for all stages of a proceeding before the CCB. The proposed rule includes procedures for the initial stages of the proceeding, including the following:

  • Filing an initial claim,
  • Compliance review by a copyright claims attorney,
  • Service and waiver of service,
  • CCB issuance of a second notice,
  • Opting out, and
  • Filing a response and any counterclaims.

The Copyright Office welcomes comments on the proposed procedures, which were developed in light of the statutory mandate to create an efficient and user-friendly forum for small copyright claims.
