USPTO releases additional information on the COVID-19 Prioritized Examination Pilot Program

On May 8, the United States Patent and Trademark Office (USPTO) announced the COVID-19 Prioritized Examination Pilot Program, permitting COVID-19-related applications filed by small and micro entities to be put on a fast track for patent examination. Today, the USPTO launched a related webpage, where you can find additional resources and information pertinent to the program.
As outlined in the official notice, up to 500 qualifying patent applications will be accepted for prioritized examination and exempted from prioritized examination fees. The USPTO will endeavor to reach final disposition of applications in this program within six months if applicants respond promptly to communications from the USPTO.

New trademarks examination guide on cheeses and processed meats

The USPTO has issued a new examination guide titled “Marks Including Geographic Wording that Does Not Indicate Geographic Origin of Cheeses and Processed Meats.” The guide sets out procedures for examining applications for cheeses and processed meats in which the mark includes geographic wording that does not indicate geographic origin, but otherwise may be a generic designation for such goods.

USPTO announces COVID-19 Prioritized Examination Pilot Program for small and micro entities

The United States Patent and Trademark Office (USPTO) today announced a new COVID-19 Prioritized Examination Pilot Program.
Under this new pilot program, the USPTO will grant requests for prioritized examination to applicants that qualify for small or micro entity status without payment of the typical fees associated with other prioritized examination. In addition, the USPTO will endeavor to reach final disposition of applications in this program within six months if applicants respond promptly to communications from the USPTO.

USPTO to allow filing of plant patent applications and correspondence via patent electronic filing systems in response to the COVID-19 outbreak

In response to the COVID-19 outbreak, the United States Patent and Trademark Office (USPTO) today announced it will temporarily permit the filing of plant patent applications and follow-on documents via the USPTO patent electronic filing systems (EFS-Web or Patent Center) until further notice. Filers are reminded that only registered users of the USPTO patent electronic filing systems may file follow-on documents into existing applications via the USPTO patent electronic filing systems.
The USPTO considers the effects of the COVID-19 outbreak to be an “extraordinary situation” within the meaning of 37 CFR 1.183. The requirements for filing such plant patent applications and follow-on documents via the USPTO patent electronic filing systems were developed to assist filers and facilitate the USPTO’s identification and processing of the plant patent applications and follow-on documents during the pandemic.

USPTO releases a form to assist with making a statement of delay due to COVID-19

The USPTO has released a form for making a statement of delay due to the COVID-19 outbreak. The form is in response to requests from applicants for guidance on how best to make a statement and will assist the office in processing these requests.

USPTO launches platform to facilitate connections between patent holders and potential licensees in key technologies

The United States Patent and Trademark Office (USPTO) today unveiled a new web-based intellectual property (IP) marketplace platform, Patents 4 Partnerships, to provide the public with a user-friendly, searchable repository of patents and published patent applications related to the COVID-19 pandemic that are indicated as available for licensing.
The new platform will facilitate the voluntary licensing and commercialization of innovations in a variety of key technologies, and help disseminate valuable patent information.
As President Donald J. Trump noted in his Proclamation on World Intellectual Property Day, 2020: “The importance of intellectual property has never been more apparent than it is now, as we continue the ongoing battle against the coronavirus.”
Patents 4 Partnerships may contribute toward this battle by helping to bring to the marketplace new products and technologies for the prevention, treatment, and diagnosis of COVID-19. In the future, the platform may be expanded to include other technologies.
“Patents 4 Partnerships is a meeting place that enables patent owners who want to license their IP rights to connect with the individuals and businesses who can turn those rights into solutions for our health and wellbeing,” said Andrei Iancu, Under Secretary of Commerce for Intellectual Property and Director of the USPTO. “With an initial focus on COVID-19, the platform shows how innovation can contribute to the nation’s response to this critical health emergency.”
Patents 4 Partnerships allows users to search and sort information in a variety of easy-to-use ways, including by keyword, inventor name, assignee and issue date. At launch, its contents have been drawn from a variety of public sources, including the USPTO, the Federal Laboratory Consortium for Technology Transfer (FLC Business), the AUTM Innovation Marketplace (AIM), universities, and a number of federal agencies, including the National Institutes of Health, the Department of Energy, the National Aeronautics and Space Administration, the Food and Drug Administration, the Centers for Disease Control and Prevention, the Department of Defense and the Department of Veterans Affairs databases.
Users are invited to send comments through the link provided on the main page of the platform. IP owners are invited to submit additional technologies that they believe are related to the COVID-19 crisis.
